1. Purpose and Application
The main Contract is a standard PRC model contract for package tours operated within Mainland China. International bookings arranged through OStar Experience may involve customised private itineraries, cross-border communication and payments, foreign currencies, advance supplier commitments, language-specific guides, private transport and reservations made well before arrival in China. The parties therefore agree that the payment, cancellation and other international booking terms contained in this Annex shall apply to the Traveller's booking. The main Contract shall continue to apply to all matters not expressly addressed or amended in this Annex.
2. Booking Documents
The complete booking agreement consists of: • the main Group Domestic Travel Contract; • this Annex; • the final confirmed itinerary; • the final quotation and payment schedule; and • any later written amendment accepted by both parties. Draft itineraries, preliminary quotations and promotional materials shall not constitute the final booking unless expressly confirmed in writing.
3. Booking and Payment Schedule
The booking shall be confirmed upon receipt of the required traveller information, acceptance of the booking documents and payment of the initial deposit. Unless otherwise stated in the final quotation, payment shall be made as follows: Initial Deposit: 10% of the total booking value Payable upon booking confirmation. The deposit secures the itinerary planning and initial supplier reservations and is non-refundable once the booking has been confirmed. Reservation Payment: 40% of the total booking value Payable no later than 90 days before departure. Final Balance: 50% of the total booking value Payable no later than 60 days before departure. For bookings confirmed fewer than 90 days before departure, all instalments already due shall be payable upon confirmation. For bookings confirmed fewer than 60 days before departure, the full tour price shall normally be payable immediately. All payments shall be made only to the company account stated in an official invoice or written payment instruction issued or confirmed by Shenzhen Baochun International Travel Group Co., Ltd. International transfer fees, intermediary bank charges and currency-conversion costs incurred in making payment shall be borne by the Traveller unless otherwise agreed in writing. The amount received by the designated company account should equal the amount stated as due on the applicable invoice.
4. Cancellation and Refund Policy
The Traveller may cancel the booking by giving written notice to the travel agency or OStar Experience. The effective cancellation date shall be the date on which the written notice is received. More Than 90 Days Before Departure • The initial deposit is non-refundable. • Any payments received in excess of the deposit shall be refunded, less any separately identified non-refundable third-party costs already incurred or contractually committed. Between 60 and 89 Days Before Departure • The Traveller shall receive a refund equal to 50% of the total booking value. Fewer Than 60 Days Before Departure • No refund shall normally be available because accommodation, private transport, guides, tickets and other local services will generally have been confirmed and financially committed. Non-Refundable Third-Party Costs Regardless of the cancellation date, certain reservations may be non-refundable or only partially refundable once confirmed. These may include: • domestic flights and railway tickets; • hotel deposits; • cruise, attraction or event tickets; • private vehicle and specialist guide reservations; • permits and name-specific bookings; • customised activities and exclusive venue reservations. Any such deduction shall be limited to amounts actually paid, contractually committed or confirmed as non-refundable by the relevant supplier. Where a refund is due, it shall normally be processed within ten working days after the refundable amount has been confirmed with the relevant suppliers. International banking and payment-processing times are outside the parties' direct control. Refunds shall normally be issued in the currency and through the payment method originally used. Reasonable bank charges and exchange-rate differences may be deducted unless the cancellation resulted from a breach attributable to the travel agency.
5. Changes Requested by the Traveller
Requests to change travel dates, itinerary, hotels, room categories, transport, guide language, activities or traveller numbers must be submitted in writing. No requested change shall become binding until it has been confirmed in writing by the travel agency. Any additional supplier charges, fare differences, cancellation costs or other expenses resulting from a Traveller-requested change shall be borne by the Traveller. Where an accepted change results in a recoverable reduction in costs, the corresponding saving shall be refunded or credited to the Traveller. OStar Experience and the travel agency shall use reasonable efforts to accommodate requested changes and minimise additional costs, but availability cannot be guaranteed.
6. Operational Changes and Unavoidable Events
The travel agency may make reasonable changes where necessary because of weather, traffic restrictions, transport disruption, attraction closures, safety concerns, government measures, supplier unavailability or other circumstances beyond its reasonable control. Where reasonably possible, replacement services shall be of an equivalent or higher standard. If force majeure or another unavoidable event prevents the itinerary from continuing, the parties shall first consider postponement, itinerary adjustment, replacement services or another reasonable solution. Where the affected services must be cancelled, the travel agency shall refund the remaining recoverable balance after deducting actual and non-refundable costs already paid or contractually committed to service providers, subject to applicable law.
7. International Flights, Visas and Travel Insurance
Unless expressly included in the final quotation, international flights, visas and travel insurance are not included in the tour price. The Traveller is responsible for holding a valid passport, obtaining the required visa or satisfying any applicable visa-free entry requirements, and providing accurate personal information for reservations and ticketing. Visa refusal, failure to apply in time or failure to satisfy entry requirements shall normally be treated as cancellation for reasons attributable to the Traveller, and the cancellation policy above shall apply. International travellers are strongly advised to obtain comprehensive travel insurance covering trip cancellation, medical treatment, emergency evacuation, travel disruption, baggage loss and the activities included in the itinerary.
8. Complaints and Assistance
Any service issue should be reported as soon as reasonably possible to the tour guide, local operator, travel agency or OStar Experience so that reasonable corrective action may be taken during the trip. Both parties shall take reasonable measures to prevent avoidable losses from increasing. Where a confirmed service is not provided for reasons attributable to the travel agency or its service provider, the Traveller shall retain the remedies available under the main Contract and applicable law.
9. Priority of Terms
This Annex and the main Contract shall be read together. Where this Annex expressly provides different commercial terms regarding payment, cancellation, refunds or international booking arrangements, this Annex shall prevail for the relevant booking. Nothing in this Annex shall exclude, reduce or restrict any mandatory right or remedy granted to the Traveller under the laws and regulations of the People's Republic of China. All provisions of the main Contract not expressly amended by this Annex shall remain in full force and effect.
10. Confirmation and Effectiveness
The Traveller confirms that the payment schedule and cancellation and refund policy contained in this Annex have been clearly presented and explained before payment. This Annex shall become effective upon signature, official seal, electronic signature or other express written acceptance by the Traveller and the travel agency.
